Pending State Legislation
New proposed state legislation may make it mandatory for residents to have LTC insurance in a growing number of states. In 2019, Washington state passed the first-of-its-kind legislation requiring employees to pay a .58% payroll tax unless they could provide proof of qualifying long-term care coverage. CALIFORNIA
Long-Term Care Insurance Task Force
- The California LTC Task Force has recommended several options for establishing a statewide long-term care insurance program and commented on the respective degrees of feasibility of those options in a report submitted to the commissioner, the Governor, and the Legislature on December 23, 2022, entitled the AB 567 Oliver Wyman Feasibility Report.
- Committee meeting held December 18, 2023, to review the Task Force Actuarial Report to review preliminary recommendations.
- No legislation was introduced prior to the February 16, 2024, deadline.
PENNSYLVANIA
Bill Information - House Bill 844; Regular Session 2023-2024 - PA General Assembly (state.pa.us)- House Bill 844 (Long-Term Care Trust Act) was introduced in April 2023 to create a state long-term care program. It was referred to the Senate Health and Human Services Committee on April 10, 2023. No hearings are scheduled at this time.
- The initial tax rate proposed is 0.58% based on the bill, the same percentage amount as seen with the WA Cares Fund in Washington state.
- The bill includes an opt-out provision for "An employee who demonstrates that the employee has long-term care insurance is exempt from the premium assessment."

- Funds were approved in August 2023 for actuarial study on statewide long-term care insurance program. The bill to create the LTC task force was favorably reported by the Joint Elder Affairs Committee and has been referred to the Joint Rules Committee.
MINNESOTA

- The Minnesota Department of Human Services Aging and Disability Services Administration Division published a Request for Proposal for a Contractor to Study Options to Increase Access to Long Term Care Financing, Services and Support in Minnesota. A consultancy firm was selected in April 2023.
- The consultancy work will partner with actuarial specialists to evaluate funding options and develop pricing and sustainability recommendations.
KENTUCKY

- House Joint Resolution 100 was introduced in February 2024 directing the Department of Insurance to create an LTC task force to explore the feasibility of implementing a statewide insurance program for long-term care.
WASHINGTON
WA Cares Fund - Long-Term Care Benefits
- Workers began contributing to WA Cares Fund on July 1, 2023, via payroll tax.
- The Long Term Services and Supports (LTSS) Trust Commission released a recommendation report with suggestions to improve the WA Cares program. All recommendations require legislative action to implement. Senate Bill 6072 incorporated recommendations from the LTSS Trust report. Washington State Legislature
